Copyright Infringement Policy (DMCA)
In compliance with the Digital Millennium Copyright Act (“DMCA”), we have established the following policy regarding claims of copyright infringement.
We reserve the right to:
-
Block access to or remove content that we reasonably believe infringes on copyrighted material and has been unlawfully copied or distributed by any of our advertisers, affiliates, partners, members, or users; and
-
Suspend or terminate service for individuals who repeatedly violate copyright rights.
Your use of Mainecorner services remains subject to our Terms of Service, which incorporate this Copyright Policy. Any terms not specifically defined here carry the meaning given in the Terms of Service.
How to Report Copyright Infringement
If you believe that material available through our Services infringes upon your copyright (or the copyright of someone you are authorized to represent), you may send a written notice to our Designated Agent including the following details:
-
A physical or electronic signature of the copyright owner (or authorized representative);
-
Identification of the copyrighted work(s) claimed to have been infringed;
-
Identification of the infringing material to be removed (with sufficient detail for us to locate it);
-
A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
-
Your contact information (name, address, phone number, and email address if available);
-
A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
What Happens After We Receive a Valid Notice
Once we receive a complete and proper DMCA notice, we may:
-
Remove or disable access to the allegedly infringing content;
-
Notify the content provider that their material has been removed or disabled;
-
Terminate the content provider’s access if they are found to be repeat infringers.
Submitting a Counter-Notice
If you are the content provider and believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notice with our Designated Agent. Your counter-notice must include:
-
A physical or electronic signature;
-
Identification of the material that was removed or disabled, and the location where it appeared before removal;
-
A statement that you have a good-faith belief the material was removed or disabled in error;
-
Your name, address, phone number, email (if available), and a statement consenting to the jurisdiction of the appropriate court (or if outside the U.S., a court where MaineCorner is located) and agreeing to accept service of process from the original complainant.
If we receive a valid counter-notice, we may forward it to the original complainant. Unless the complainant files a legal action within 10 business days, we may restore the removed material or reinstate access at our discretion.
